Data Protection Declaration and Consent for the Use of Data by freevoice.biz
Data protection is a matter of trust and your trust is important to us. We shall respect your private and personal sphere. The protection as well as the legally-compliant collection, processing and use of your personal data are thus an important concern for us. So that you can feel secure when visiting our web pages, when we process your personal data, we strictly follow the statutory directives and would like to inform you herein about our collection and our use of your data. By approving the following Data Protection Declaration, you are hereby granting your consent for freeVoice AG (Switzerland) and/or freeVoice Germany GmbH (hereafter: freeVoice) to collect, process and use your personal data subject to adherence to the data protection laws and the following provisions.
 
1. Responsible Authority
The responsible authority for the collection, processing and use of your personal data in accordance with the Data Protection Act shall be freeVoice Germany GmbH. 2. Collection, Processing and Use of Personal Data
2.1 Personal Data
Personal data shall be considered to be data about factual or personal circumstances of a defined or definable natural person. This shall include, for example, your name, your telephone number, your address as well as all inventory data which you disclose to us during the registration process and when setting up your customer account. Statistical data, which we, for example, collect during your visit to our web shop which cannot directly be attributed to your person are not considered to be personal data. For example, these are statistics which indicate which pages of our shop are particularly popular or how many users visit certain pages of the freeVoice shop.

2.2 Customer Account
For each customer who correspondingly registers, we shall set up password-protected direct access to his inventory data (customer account) which we have saved. Here, you can view the data about your completed, open and recently-shipped orders and manage your address data, bank details and the newsletter. You shall be obliged to keep the personal access data confidential and to not make them available to unauthorised third parties. We assume no liability for misused passwords unless we must assume responsibility for the misuse. Through the “Remain logged-in” function, we would like to make your visit to our web pages as convenient as possible. This function will enable you to use our services without having to log in again each time. However, for security reasons, you will once again be asked to enter your password if, for example, your personal data are supposed to be changed or you would like to cancel an order. We recommend not using this function if the computer is being used by multiple users. We wish to point out that the “Remain logged-in” function will not be available if you use a setting which automatically deletes the saved cookies after each session.

2.3 Collection, Processing and Use of Your Personal Data
Data protection is very important to us. Thus, during the collection, processing and use of your personal data, we strictly follow the statutory directives. We collect, save and process your data for the entire processing of your purchase including any subsequent warranties, for our services, the technical administration as well as our own marketing purposes. Your personal data shall be passed on or otherwise transmitted to third parties only if this is required for the purpose of the implementation of the contractual agreement or billing purposes or you have approved this in advance. During the processing of the order, for example, the service providers (e.g. carriers, logistics specialists, banks) that we deploy shall receive the required data for processing the order and the mandate. The data passed on in such a manner may be used by our service providers merely for the fulfilment of their task. Any other use of the information is not permitted and shall also not be done by any of our commissioned service providers. For your order, we shall require your correct name, address and payment data. We require your e-mail address so that we can confirm the receipt of the order to you and communicate with you. We also use these data for your identification (customer log-in). Furthermore, you shall receive your order and shipping confirmation via your e-mail address. Your personal data shall be deleted insofar as the statutory retention obligations do not oppose this and if you have asserted a right of deletion, if the data for the fulfilment of the purpose being pursued with the saving are no longer required or if the saving of such data is impermissible owing to other legal reasons.

2.4 Use of Your Data for Advertising Purposes
In addition to the processing of your data in order to process your purchase from freeVoice, we shall also use your data in order to communicate with you about your orders, specific products or marketing campaigns and to recommend products or services to you which could interest you. You may, at any time, as a whole or for individual measures, object to the use of your personal data for advertising purposes without incurring any other costs for so doing than the transmission costs based upon the basic rates. 2.4.1 Newsletter
For sending the newsletter, we use the so-called opt-in process, i.e. we will only then send a newsletter via e-mail if you have expressly confirmed in advance that we are supposed to activate the newsletter service. If you should later wish to receive no more newsletters from us, you can at any time cancel this newsletter without incurring any other costs than the transmission costs based upon the basic rates. A notification in text form to the contact data (e.g. e-mail, fax, letter) specified under Clause 1 shall suffice in this regard. Naturally, you will also find an unsubscribe link in each newsletter.

2.4.2 Product Recommendations via E-Mail
As a customer of freeVoice, you will receive product recommendations from us via e-mail upon a regular basis. You shall receive these product recommendations from us regardless of whether you have subscribed to a newsletter. In this manner, we wish to provide you with information about products from our range of offerings which could interest you based upon your last purchases from us. In this regard, we strictly follow the statutory directives. Insofar as you wish to receive no more product recommendations or collectively no more advertising messages from us, you may at any time lodge an objection to them without incurring any other costs than the transmission costs based upon the basic rates. 2.4.3 Individual Advertising for You
Information which we receive from you will help us, upon an on-going basis, to improve your purchasing experience and to design it to be customer-friendly and individual for you. The information transmitted by you and automatically generated shall be used in order to design advertising which is tailored to you and your interests. In order to do this, we shall use the existing information, e.g. receipt and read confirmations of e-mails, information about your computer and your connection to the Internet, your operating system and platform, your order history, your service history, date and time of the visit to the homepage as well as the products which you have viewed. We shall use this information exclusively in pseudonymised form. Through the analysis and evaluation of this information, it will enable us to improve our web pages and our Internet site as well as to thus send you individual advertising. That is to say, advertising which recommends products to you which could actually also interest you. Our goal is to design our advertising to be more beneficial and more interesting to you. Thus, the evaluation and the analysis of the pseudonymised data collected from you will help us to not just send you indiscriminate advertising. Instead, we will send you advertising, e.g. the newsletter, product recommendations, via e-mail or a direct mailing, which will correspond to your areas of interest. In this regard, for example, it will also be compared which of our advertising e-mails you open in order to avoid sending you unnecessary e-mails. I hereby approve that freeVoice will use the data which I have provided and additional information that has been saved to my customer account as well as pseudonymised usage data in order to present me with personalised advertising and/or special offers and services. If you do not wish to receive personalised advertising, you may lodge an objection to it at any time–collectively or for specific measures. 2.4.4 Sweepstakes, Market and Opinion Research
For sweepstakes, we shall use your data in order to make sweepstakes’ announcements and to advertise our offerings. Where applicable, you can find detailed comments in our Participation Terms and Conditions on the respective sweepstakes contest. In addition, we shall use your data for market and opinion research. Naturally, we shall use these data exclusively in anonymised form for statistical purposes and only for freeVoice. Your responses to the surveys shall not be passed on to third parties or published. We shall not store the answers from our surveys in commingled fashion together with your e-mail address or other personal data. I hereby approve that freeVoice shall process and use my personal data for market and opinion research for its own purposes. You may, at any time, collectively or for certain measures, object to the use of your data for market and opinion research without incurring any other costs for this than the transmission costs based upon the basic rates. 3. Cookies
The acceptance of cookies is no pre-requisite for visiting our web pages. However, we wish to point out that the use of the shopping basket function and the ordering of products is possible only if you permit us to place cookies. What are cookies? Cookies are small files which are stored on your data carrier and which save certain settings and data for exchange with our system via your browser. In principle, one differentiates between two different types of cookies: So-called session cookies which are deleted as soon as you close your browser and temporary/permanent cookies which are saved for a longer timeframe or for an indeterminate period of time on your data carrier. This storage helps us to correspondingly design our web pages and our offerings for you and to facilitate your use thereof by, for example, saving certain data that you have already inputted in such a manner that you do not have to constantly repeat them. Which cookies does freeVoice use? Most of the cookies which we use are automatically deleted once again by your hard disk (thus also session cookies) after the end of the browser session (end of the session). During each additional visit, it is then automatically recognised that you had already visited us and which inputted data and settings you prefer. These temporary or also permanent cookies (lifespan of 1 month to 10 years) shall be saved on your hard disk and deleted on their own after the prescribed timeframe. In particular, these cookies serve to make our web site more user-friendly, more effective and more secure. Thanks to these files, for example, it is possible for you to receive information displayed on the page that is specifically tailored to your interests. The exclusive purpose of these cookies is to optimally tailor our web site to your wishes as the customer and to enable you to surf our web site as comfortably as possible. What data are saved in the cookies? No personal data are saved in the cookies used by freeVoice. The cookies which we use can thus not be attributed to a certain person and thus also not to you. When activating the cookie, it will be assigned an identification number. Are there also cookies from third-party providers (so-called third-party cookies)? freeVoice avails itself of several advertising partners who help to design the Internet site and the web pages to be more interesting for you. Thus, during a visit to the web pages, cookies are also saved by the partner companies on your hard disk. They are temporary/permanent cookies which are automatically deleted after the prescribed timeframe. These temporary or also permanent cookies (lifespan of 14 days to 10 years) shall be saved on your hard disk and deleted on their own after the prescribed timeframe. The cookies from our partner companies also contain no personal data. Data are collected merely under a user ID in pseudonymised form. This encompasses, for example, data regarding which products you have viewed, whether something was purchased, which products were searched for, etc. In this regard, some of our advertising partners also collect information beyond our web pages, e.g. which pages you had previously visited or which products were of interest to you in order to thus be able to show you advertising which optimally corresponds to your interests. At no time shall these pseudonymised data be commingled with your personal data. They shall exclusively have the purpose of enabling our advertising partners to appeal to you with advertising which could actually indeed interest you. Re-Targeting Our Web Sites uses so-called re-targeting technologies in this regard. We use these technologies in order to design the Internet site to be more interesting to you. This technology makes it possible to appeal to Internet users on our partners’ web sites with advertising who have already shown interest in our shop and our products. We are convinced that, as a rule, the insertion of personalised, interest-related advertising is more interesting for the Internet user than advertising which has no such personal correlation. The insertion of these advertisements on our partners’ pages shall be done upon the basis of a cookie technology and an analysis of the prior usage behaviour. This form of advertising is done in a fully-pseudonymised manner. No personal data are saved and no user profiles are also commingled with your personal data. I hereby approve that so-called cookies will be used and thus usage data about me shall be collected, stored and used. Moreover, I hereby approve that my data will be saved in cookies beyond the end of the browser session and, for example, may be retrieved again during my next visit to the web pages. I may revoke this consent at any time with effectiveness for the future by refusing to accept cookies in my browser settings. How can I prevent the storage of cookies? In your browser, you can adjust your settings so that the saving of cookies is accepted only if you approve this. 4. Log Files
For each access to freeVoice, usage data are transmitted by the respective Internet browser and saved in protocol files, the so-called server log files. The data sets saved in this manner shall contain the following data: Date and time of day of the retrieval, name of the retrieved page, IP address, referrer URL (URL of origin from which you arrived on the web pages), the transmitted data quantity as well as the product and version information of the browser being used.

5. Web Analysis
In order to constantly improve and optimise our web site, we use so-called tracking technologies. For this, we use the services of Google Analytics.

5.1 Google Analytics
Google Analytics is a service of Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA ("Google"). Google Analytics uses "cookies", thus text files which are stored on your computer and enable an analysis by Google of the use of our web site. As a rule, the information collected by the cookie regarding the use of our web pages (including your IP address) are transferred to a Google server in the USA and stored there.

We wish to point out that Google Analytics was expanded on our web pages with the code “gat._anonymizeIp();” in order to ensure an anonymised collection of IP addresses (so-called IP masking).

Thus, upon our request, your IP address will be collected by Google merely in shortened form which will ensure anonymisation and enable no inferences about your identity. In the case of the activation of IP anonymisation on our web pages, your IP address will be shortened in advance by Google within the member countries of the European Union or in other contracting countries to the European Economic Area Convention. Only in exceptional cases shall the full IP address be transferred to a Google server in the USA and shortened there. Moreover, Google shall fulfil the data protection directives of the "U.S. Safe Harbour" Convention and is registered with the "Safe Harbour" Programme of the U.S. Department of Commerce. Google shall use the aforementioned information in order to evaluate your use of our web pages, in order to compile reports about the web site activities for us and in order to render additional services for us in conjunction with the use of web sites and the Internet. The IP address transmitted by your browser within the parameters of Google Analytics shall not be commingled with other data by Google. Any transfer of these data by Google to third parties shall only then be undertaken based upon the statutory directives or within the parameters of contracted data processing. Google shall in no way commingle your data with other data it has collected. Through the use of these web pages, you are hereby declaring your approval of the processing of the data collected about you by Google and the previously-described art and manner of data processing as well as the designated purpose.

You can prevent the saving of cookies by correspondingly changing the settings on your browser software; however, we wish to point out that, in this case where applicable, you will not be able to comprehensively use all functions of our web pages. 5.4 Doubleclick by Google
Doubleclick by Google is a service of Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA ("Google"). Doubleclick by Google uses cookies in order to present you with advertising that is relevant to you. In this regard, your browser will be assigned a pseudonymised identification no. (ID) in order to examine which advertisements were inserted into your browser and which advertisements were clicked on. The cookies contain no personal information. The use of Facebook “I like” buttons by DoubleClick cookies enables Google and its partners’ web sites to merely insert advertisements upon the basis of prior visits to our web pages or other web pages on the Internet. The information generated by the cookies shall be transferred by Google, for evaluation purposes, to a server in the USA and stored there. Google shall fulfil the data protection provisions of the "U.S. Safe Harbour" Convention and is registered with the "Safe Harbour" Programme of the U.S. Department of Commerce. A transfer of the data by Google to third parties shall be undertaken only based upon the statutory directives or within the parameters of contracted data processing. Google shall in no way commingle your data with other data it has collected. 6. Social Plug-Ins
Our Internet site uses social plug-ins ("Plug-Ins") from various social networks. With the aid of these Plug-Ins, you can, for example, share contents or recommend products. If these Plug-Ins are activated, your browser will create a direct connection to the servers of the respective social network as soon as you visit a web page of our Internet site. The contents of the Plug-In shall be transmitted by the social network directly to your browser and shall be integrated by your browser into the web site. Even if you are not logged-in to the social networks, data can be sent to the networks from web sites with active social Plug-Ins. Through an active Plug-In, each time the web page is visited, a cookie will be placed with an identification code. Because your browser will send along this cookie for each connection with a network server without this having to be requested, the network could thus in principle create a profile of which web pages the user with the assigned identification code has visited. It would then also be possible to attribute this identification code later–for example, when subsequently logging in to the social network–to a person again. 7. Secure Data Transfer
We shall transfer your personal data securely via encryption. This shall also be valid for your order and also for the customer log-in. In this regard, we use the SSL (Secure Socket Layer) coding system. Admittedly, no one can guarantee absolute protection. However, we safeguard our web pages and other systems through technical and organisational measures against loss, destruction as well as the accessing, manipulation or dissemination of your data by unauthorised persons.

8. Information Rights of the Affected Party
In accordance with the Data Protection Act, our customers have, among other rights, a right to free-of-charge information about their stored data as well as, where applicable, a right to the correction, blocking or deletion of data.
